This notice serves to inform all stakeholders including ship masters, seafarers, ship owners, ship operators, shipping companies, mariners and marine service providers that effective 1st of June, 2024, the Maritime Safety Authority of Fiji (MSAF) will commence the issuance of Marine Infringement Notices pursuant to section 262 and 263 of the Maritime Transport Act 2013 for any relevant non-compliances or infringements found by the authorised officers.
262 Infringement offences
(1) In this Act, “infringement offence” means an offence specified as such in this Act or regulations made under this Act.
(2) Where any person is alleged to have committed an infringement offence, that person may either be—
(a)proceeded against summarily for the alleged offence; or
(b)served with an infringement notice as provided in section 263.
263 Infringement notices
(1) Where the Chief Executive Officer, or any authorised officer by the Chief Executive Officer, observes a person committing an infringement offence or has reasonable grounds to believe such an offence is being or has been committed by that person, an infringement notice in respect of that offence may be issued to that person by the Chief Executive Officer or the authorised officer.
All ship masters, seafarers, ship owners, ship operators, shipping companies, mariners and marine service providers are hereby notified to ensure compliance with the requirements outlined in the Maritime Transport Act 2013 and its associated regulations to avoid penalties and enforcement actions. Stakeholders are strongly encouraged to ensure full compliance with legal and safety requirements to avoid being sanctioned for breach under the Marine Infringement Notices.
